Nach der Pandemie wurde vom Bundesrat bzw. vom BAG versprochen, dass die Versorgungssicherheit im Gesundheitsbereich dringend priorisiert und überdacht werden müsse, bzw. dass die Abhängigkeit vom Ausland im Ernstfall / Katastrophenfall / Kriegsfall usw. unsere Versorgungssicherheit stark gefährde.

Schon die Brandkatastrophe in Crans-Montana hat gezeigt, dass wenn über 100 Personen aufs Mal hospitalisiert werden müssen, der Ernstfall eintritt und wir zu wenig von allem haben: Infusionen, Medikamente, Wundmaterial etc. Enea Martinelli, einer der renommiertesten Spitalapotheker der Schweiz, hat bereits früher davor gewarnt. Das ist sehr besorgniserregend, insbesondere in Anbetracht der geopolitischen Lage.

Zudem zeigt die baldige Schliessung der Firma Bichsel AG in Interlaken einmal mehr, dass Private (hier Galenica) anscheinend nicht sonderlich interessiert sind an der Grundversorgung.

Dazu stellen sich folgende Fragen an den Bundesrat:

1. Eine zuverlässige Versorgung mit Arzneimitteln und Medizinprodukten ist für die Bevölkerung und das Gesundheitssystem sehr wichtig. Im Gesundheitsbereich gibt es seit Jahren regelmässig Engpässe. Die Ursachen dafür sind vielfältig, zum Beispiel die Verlagerung globaler Produktionskapazitäten in Niedriglohnländer, die Konzentration auf eine geringe Anzahl von Anbietern sowie Störungen in den Lieferketten. Ein weiterer Faktor sind die spezifischen Gegebenheiten des kleinen Schweizer Marktes.

2. Die Vorsorge ist in vielen Bereichen der Arzneimittelversorgung weiterhin grundsätzlich ausreichend; die Versorgungslage ist jedoch bei bestimmten Produktgruppen angespannt. Lücken bestehen vor allem bei günstigen Medikamenten, die im Alltag unentbehrlich sind, wie z.B. Antibiotika oder Arzneimittel gegen chronische Erkrankungen. Problematisch ist dies vor allem dann, wenn Präparate medizinisch schwer ersetzbar sind, etwa bei Parkinsonerkrankungen, bei Epilepsie oder bei psychischen Erkrankungen.

3. Der Bundesrat verfolgt die Versorgungslage seit Jahren aufmerksam und hat bereits zahlreiche Massnahmen zur Verbesserung der Situation umgesetzt.

Im Rahmen des Geltungsbereiches des Landesversorgungsgesetz (LVG; SR 531) unterliegen bereits zahlreiche lebenswichtige Arzneimittel der Melde- und Lagerpflicht. So können solche Versorgungsstörungen so weit wie möglich über Freigaben von Pflichtlagerbeständen überbrückt werden.

2023 wurde die Teilabgabe von Medikamenten und eine einfachere Vergütung bei Importen ermöglicht.

Am 21. August 2024 verabschiedete der Bundesrat ein Massnahmenpaket zur Stärkung der Versorgungssicherheit, insbesondere durch Verbesserungen beim Marktzugang, Erleichterungen bei der Eigenherstellung von Arzneimitteln durch den Bund sowie gezielte Anreize für Hersteller (s. Medienmitteilung «Bundesrat verstärkt Massnahmen gegen Engpässe bei den Arzneimitteln»).

Im Rahmen der Umsetzung des Kostendämpfungspakets 2 (Eröffnung Vernehmlassung am 18. Februar 2026) ist vorgesehen, dass von der Obligatorischen Krankenpflegeversicherung übernommene Arzneimittel mit geringer Rentabilität bei der dreijährlichen Überprüfung durch das Bundesamt für Gesundheit nicht mehr auf ihre Wirtschaftlichkeit geprüft werden müssen. Damit soll verhindert werden, dass Arzneimittel wegen fehlender Rentabilität vom Schweizer Markt zurückgezogen werden.

Mit dem am 20. März 2026 verabschiedeten, umfassenden Ansatz will der Bundesrat durch koordinierte Massnahmen, die zeitnah bis langfristig umgesetzt werden, die Versorgung weiter stärken (s. Medienmitteilung «Bundesrat will die Versorgung mit Medikamenten verbessern»). So werden mit der Revision 3b des Heilmittelgesetzes (Eröffnung Vernehmlassung Sommer 2026) Optimierungen beim Inverkehrbringen von Arzneimitteln und beim vereinfachten Zulassungsverfahren, sowie Erleichterungen für Apotheken zur Herstellung von Arzneimitteln vorgeschlagen. Auch sollen e-Leaflets und die Übernahme von EU-Verpackungen ermöglicht werden. Zudem wird eine mögliche Anerkennung von EU-Zulassungen für bestimmte Arzneimittel geprüft. In einer zweiten Phase wird die Kategorisierung von Arzneimitteln nach Versorgungsrelevanz sowie die Verbesserung der Kommunikation über Engpässe angestrebt.

Um langfristig auch strukturelle Massnahmen umsetzen zu können, hat der Bundesrat im März 2026 die Botschaft zum direkten Gegenentwurf zur Volksinitiative «Ja zur medizinischen Versorgungssicherheit» verabschiedet. Dieser soll – abhängig von den Beschlüssen des Parlaments sowie dem Ausgang einer Volksabstimmung – die bestehenden Kompetenzen des Bundes gezielt erweitern.

4. Die Versorgung der Schweiz mit wichtigen medizinischen Gütern liegt in der Verantwortung der Privatwirtschaft. Auf staatlicher Ebene sind grundsätzlich die Kantone für die Versorgungssicherheit zuständig (vgl. Art. 3 und Art. 42 Abs. 1 BV [SR 101]). Der Bund kann Massnahmen zur Versorgung des Landes mit lebenswichtigen Gütern und Dienstleistungen nur in schweren Mangellagen treffen, denen die Wirtschaft nicht selbst zu begegnen vermag (vgl. Art. 102 BV und das LVG). Zudem kann der Bund auch im Bereich der Bekämpfung von übertragbaren Krankheiten Massnahmen zur Versorgung der Bevölkerung mit Heilmitteln vorsehen (vgl. Art. 118 Abs. 2 Bst. b BV und Art. 44 Epidemiengesetz [EpG; SR 818.101]).
