Im Rahmen der Revision der Schulverordnung (neu: Volksschulverordnung) wollten der Regierungsrat und der Erziehungsrat unter anderem den wachsenden Herausforderungen in der Volksschule Rechnung tragen. Im Rahmen der Vernehmlassung vom Herbst 2023 schlugen sie daher eine Reduktion der maximal zulässigen Abteilungsgrössen vor. In den Vernehmlassungsantworten wurde der Bedarf an zusätzlichen Ressourcen nicht bestritten, wohl aber die Idee, diese zusätzlichen Ressourcen via Reduktion der Abteilungsgrössen bereitzustellen. Infolge dieser Rückmeldungen wurde im Bericht und Antrag an den Landrat vorgeschlagen, die zulässigen Abteilungsgrössen nicht zu reduzieren, die Schulen aber zu verpflichten, für grosse Abteilungen zusätzliche Ressourcen bereitzustellen. Diesen Vorschlag passte der Landrat in der Beratung zur Revision der Volksschulverordnung dahingehend an, dass die Schulen zusätzliche Ressourcen bereitstellen können, aber nicht müssen. Damit verbunden war indes, dass der Kanton sich an den betreffenden Kosten nicht mehr zu beteiligen hat.

\r\n\r\n

Aus diesem Grund ergriff der Verein der Lehrerinnen und Lehrer Uri das Referendum gegen die Verordnung. Er forderte, grosse Abteilungen seien (wie vom Regierungsrat dem Landrat beantragt) zwingend mit zusätzlichen Ressourcen auszustatten und der betreffende Artikel 9 der Verordnung sei entsprechend anzupassen. Nachdem das Referendum zustande gekommen war, fand am 30. November 2025 die Volksabstimmung statt, wobei das Urner Stimmvolk die Verordnung mit 72 Prozent Nein zu 28 Prozent Ja ablehnte. Somit muss die Revision der Verordnung neu aufgelegt werden.

\r\n\r\n

Da das Referendum klar auf die Anpassung von Artikel 9 abgezielt hatte, hat der nun zur Vernehmlassung vorliegende neue Verordnungsentwurf die zur Volksabstimmung gebrachte Vorlage übernommen – mit Ausnahme eben der Regelungen in Artikel 9. Hier schlagen der Erziehungsrat und der Regierungsrat eine neue Regelung vor, die den Anliegen der unterschiedlichen Anspruchsgruppen optimal Rechnung trägt: Jede Schule soll verpflichtet werden, generell Ressourcen für herausfordernde Abteilungen bereitzustellen und diese im Einzelfall bedarfsgerecht einzusetzen. Nebst dieser neuen Regelung werden aufgrund der Verzögerungen, die durch das Referendum entstanden sind, für einige Artikel Übergangsfristen nötig.
