En 2016, le Conseil fédéral avait renoncé à proposer la libéralisation complète du marché suite aux
résultat très négatifs de la consultation ouverte en 2014. En 2021, il l'a proposée à nouveau dans sa
« Loi relative à un approvisionnement en électricité sûr reposant sur des énergies renouvelables »
(connue aujourd'hui sous son surnom allemand de Mantelerlass et faisant l'objet d'une demande de
référendum au stade de la récolte de signatures), mais le Parlement a supprimé la disposition y
relative de la version adoptée en automne 2023. Toutefois, la libéralisation complète du marché
menace de revenir encore une fois par la petite porte, dans le cadre d'une nouvelle série d'accords
avec l'Union européenne, à propos desquels le Conseil fédéral a fixé sa feuille de route le 15
décembre 2023.
