Der weitaus grösste Posten beim Eigenaufwand des Bundes ist der Personalaufwand mit inzwischen über sechs Milliarden Franken jährlich (Rechnung 2021). Nicht nur beim direkten Lohn und der beruflichen Vorsorge profitieren Bundesangestellte von paradiesischen Zuständen, sondern auch andere Leistungen gehen weit über das gesetzliche Minimum hinaus. Sei es bei der Wochenarbeitszeit von 41,5 Stunden, dem Ferienanspruch von 5-7 Wochen, einer Reduktion der Stellenprozente um 20 Prozent nach Geburt/Adoption oder Finanzhilfen für die Kinderbetreuung - Bundesangestellte profitieren von grosszügigen Nebenleistungen. Angesichts der Kostenexplosion beim Bundespersonalwesen sind diese nicht mehr zu rechtfertigen. Das heutige Bundespersonalrecht ist abzuschaffen und stattdessen das Obligationenrecht anzuwenden.

Im Rahmen der Revision von 2012 des Bundespersonalgesetzes (BPG, SR 172.220.1) wurde eingehend geprüft, ob das BPG vollumfänglich durch das Obligationenrecht (OR) ersetzt werden soll. Bundesrat und Parlament haben sich klar für die Beibehaltung des BPG ausgesprochen und gleichzeitig das BPG umfassend und so weit als möglich dem OR angenähert.

Infolge dieser Anpassungen und der subsidiären Anwendung des OR (Art. 6 Abs. 2 BPG) kommt für die Angestellten der Bundesverwaltung schon heute in den meisten Bereichen des Personalrechts das private Arbeitsrecht zur Anwendung. Das BPG kennt nur noch dort eigene Regelungen, wo das OR den speziellen Gegebenheiten bei den Bundesangestellten nicht Rechnung tragen kann. So muss beispielsweisebeachtet werden, dass die Bundesverfassung die Kündigungsfreiheit des Arbeitgebers Bund einschränkt (insbesondere unter Beachtung des Gleichbehandlungsgebots, der Verhältnismässigkeit und des Willkürverbots).

Im Frühjahr 2022 hat die staatspolitische Kommission des Nationalrates (SPK-N) einen Antrag auf Anpassung des Bundespersonalrechts an das OR beraten und abgelehnt. Es ging dabei insbesondere um die Anpassung der Anstellungsverhältnisse bzw. Arbeitsverträge des Bundespersonals nach üblichen zivilrechtlichen Grundsätzen. Die SPK-N sah keinen Mehrwert in einem derartigen Wechsel.

Mit der weitgehenden Übernahme des OR hat die Bundesverwaltung eines der liberalsten Personalgesetze für öffentlich-rechtliche Angestellte in Europa. Die personalrechtlichen Regelungen der Bundesangestellten entsprechen schon heute weitgehend denjenigen der Privatwirtschaft.

Schliesslich ist festzuhalten, dass die in der Motion genannten Anstellungsbedingungen, wie die Ferienregelungen oder die Unterstützung bei der familienergänzenden Kinderbetreuung, nicht davon abhängen, ob für die Angestellten der Bundesverwaltung das BPG oder das OR zur Anwendung kommt. Sie sind Teil der Personalpolitik und in gleicher oder ähnlicher Form auch bei grösseren Arbeitgebern im Privatsektor zu finden.
