Der Bundesrat anerkennt das Anliegen der GPK-S, die Geltung der (mit dem bilateralen Luftverkehrsabkommen von der EU übernommenen) EG-Verordnung 2470/92 im Landesrecht besser sichtbar zu machen.

Die von der GPK-S vorgeschlagene Verweisung auf diese EG-Verordnung in Artikel 27 LFG hätte allerdings folgende Nachteile:

- Die Schweiz hat mit dem bilateralen Luftverkehrsabkommen eine ganze Reihe von EG-Erlassen übernommen. Es läge deshalb nicht im Interesse der Rechtssicherheit, wenn das Luftfahrtgesetz (LFG) einzig auf die EU-Verordnung 2407/92 verweisen würde.

- Die EG-Verordnung 2407/92 gehört zu jenen Erlassen der EU, die mit dem Inkrafttreten des bilateralen Luftverkehrsabkommens auf den 1. Juli 2002 in der Schweiz direkt anwendbar geworden sind. Die wortgetreue Umsetzung der Motion der GPK-S würde deshalb den falschen Eindruck erwecken, als müsse erst das LFG geändert werden, damit die EG-Verordnung 2407/92 auch in der Schweiz gilt.

Der Bundesrat ist bereit, eine rechtstechnische Lösung zu prüfen, mit welcher dem Anliegen der GPK-S ohne diese Nachteile entsprochen werden könnte, und der GPK-S über das Ergebnis seiner Prüfung zu berichten.
