Die Schweizer Bioverordnung und die EU-Ökoverordnung verbieten den Einsatz von Gentechnik im Biolandbau, ebenso die Richtlinien der nationalen und internationalen Bio-Dachverbände. Die Branche ist wertschöpfungsstark und soll sich wie in den letzten Jahren stetig weiterentwickeln können. Dies erfordert sorgfältige Regeln, falls Gentechnik in der Schweiz Einzug halten soll.

Durch Wind oder Insekten können gentechnik-freie Kulturen durch gentechnisch veränderte Pollen aus der Umgebung befruchtet werden. Dies führt zu Kontaminationen und zu unerwünschten gentechnisch veränderten Produkten, die nicht den Anforderungen der Bio-Verordnung genügen.

Das EU-Parlament schlägt mit Art. 3a der neuen NGT-Verordnung vor, dass GVO-freie Produkte, die durch GVO-Pollen kontaminiert wurden, weiterhin als «GVO-frei» oder «biologisch» vermarktet werden dürfen, wenn alle Vorkehrungen zur Vermeidung getroffen wurden. Dies bevorzugt die Anwender von GVO und täuscht die Konsumentinnen.

Bei Kontaminationen liegt die Beweispflicht beim Geschädigten, zum Beispiel beim Bio-Betrieb, der seine Produkte nicht als «Bio» verkaufen kann. Der Nachweis ist schwer gerichtsfest zu erbringen, wie die Praxis bei den Pflanzenschutzmitteln zeigt.

Koexistenz ist nicht gratis zu haben. Wenn nicht der GVO-Anwender die Kosten dafür tragen muss, verzerrt sich der Markt zulasten der Bio-Produktion.

1. Bei den neuen gentechnischen Verfahren handelt es sich in der Schweiz wie in der europäischen Union technisch und rechtlich um gentechnische Verfahren und bei den damit hergestellten Produkten um gentechnisch veränderte Organismen (GVO) (siehe auch die Antwort auf die Interpellation 24.3046 Haab «Ungezielte und gezielte Pflanzenzüchtung gleich behandeln» und den Bericht «Regulierung der Gentechnik im Ausserhumanbereich» in Erfüllung der Postulate 20.4211 Chevalley, 21.3980 WBK-N sowie 21.4345 WBK-S). Bei einem künftigen Anbau von Pflanzen aus solchen gentechnischen Verfahren muss die parallele Produktion ohne GVO – einschliesslich der Bioproduktion, in der GVO grundsätzlich verboten sind – gewährleistet bleiben; die Produktion ohne GVO ist verfassungsrechtlich geschützt. Die laufende Revision gemäss Artikel 37a Absatz 2 des Gentechnikgesetzes (GTG; SR 814.91) wird daran nichts ändern. Die Revision steht der Bioproduktion somit nicht im Weg.

2. Es gilt das Verursacherprinzip: Personen, die mit GVO umgehen, müssen nicht nur Massnahmen ergreifen, die für die Koexistenz des Anbaus mit und ohne GVO erforderlich sind, sondern auch die dadurch anfallenden Kosten tragen (Art. 2 Abs. 2 GTG).

3. und 4. Wer gentechnisch veränderte Pflanzen anbaut, muss alle erforderlichen Massnahmen treffen, um unerwünschte Vermischungen mit nicht gentechnisch veränderten Pflanzen zu verhindern. So müssen nicht nur Isolationsabstände eingehalten, sondern beispielsweise auch die Geräte sorgfältig gereinigt werden. Zudem müssen der Umgang mit den GVO dokumentiert, Produkte gekennzeichnet und Abnehmerinnen und Abnehmer informiert werden (Art. 15 ff. GTG).

Trotz dieser Massnahmen kann nicht ausgeschlossen werden, dass es zu einer Vermischung mit nicht GVO kommt, etwa indem diese mit Pollen einer gentechnisch veränderten Pflanze bestäubt werden. Entsteht dadurch ein Schaden, haftet dafür die bewilligungspflichtige Person, also diejenige Person, welche die gentechnisch veränderten Pflanzen anbaut. Diejenige Person, die Schadenersatz möchte, trägt die Beweispflicht (Art. 30 und 33 GTG).
