Die Vereinfachung der Bestimmungen zur Mehrwertsteuer ist dringend notwendig. Sie sollte sich jedoch nicht nachteilig auf Sportvereine und ehrenamtliche Tätigkeiten auswirken. Gegenwärtig sind u. a. Mitgliederbeiträge, Eintrittsgelder für die Teilnahme an sportlichen Veranstaltungen, Entgelte für die sportliche Ausbildung (Kurskosten), Tombola- und Lottoeinnahmen sowie die Vermietung von Sportanlagen von der Mehrwertsteuer ausgenommen.

Die Beibehaltung der zurzeit geltenden Ausnahmen drängt sich aufgrund der wichtigen Rolle von Sportvereinen in unserer Gesellschaft auf. Sie tragen nicht nur zum sozialen Zusammenhalt bei, sondern auch zur Integration und zur öffentlichen Gesundheit. Dabei gilt es auch zu erwähnen, dass die Personen, die für den störungsfreien Ablauf der sportlichen Aktivitäten besorgt sind, ehrenamtlich arbeiten.

Mit der Unterstützung von Swiss Olympic und Price Waterhouse Cooper haben die Sportvereine die ihnen zusätzlich erwachsenden Kosten auf mehr als 30 Millionen Franken pro Jahr geschätzt. Zu diesen neuen potenziellen Lasten würden sich noch die höheren administrativen Umtriebe gesellen, und nicht zuletzt würde sich die Abschaffung der Steuerausnahme auch auf das Angebot der sportlichen Anlässe negativ auswirken.

Der Bundesrat hat kürzlich die Vernehmlassung zur Revision des Bundesgesetzes vom 2. September 1999 über die Mehrwertsteuer (MWSTG; SR 641.20) eröffnet. Das Ziel dieser Reform liegt in einer radikalen Vereinfachung des Systems, der Gewährung grösstmöglicher Rechtssicherheit für die Steuerpflichtigen, der Erhöhung der Transparenz und in einer verstärkten Kundenorientierung der Verwaltung. Der Bundesrat hat mehrere Module zur Änderung und Verbesserung des MWSTG in die Vernehmlassung gegeben. Nach dem ersten Modul werden die Eintritte und die Startgelder zu sportlichen Veranstaltungen, Vereinsbeiträge, Tombola- und Lottoeinnahmen sowie Entgelte für die sportliche Ausbildung und die Vermietung von Sportanlagen wie bis anhin von der Steuer ausgenommen. In anderen Modulen wird die Aufhebung der meisten der heute bestehenden 25 Steuerausnahmen vorgeschlagen, darunter auch solche, die den Sport betreffen. Dies führt zu einem Höchstmass an Vereinfachung, weil aufwendige und komplexe Abgrenzungsprobleme zwischen steuerbaren und von der Steuer ausgenommenen Umsätzen wegfallen. Damit würden also Leistungen, die im Bereich des Sports erbracht werden, künftig steuerbar, sofern sie gegen Entgelt erbracht werden. Andererseits können dafür die angefallenen und die künftig anfallenden Vorsteuern in Abzug gebracht werden. Die heute auf diesen Umsätzen lastende Taxe occulte kann verringert werden, und die komplizierte Berechnung des zu kürzenden Vorsteuerabzuges entfällt.

Ob die heute in Artikel 18 MWSTG enthaltenen 25 Ausnahmen von der Steuer abgeschafft werden und welche gegebenenfalls beibehalten werden, ist eine politische Frage. Der Bundesrat wird die eintreffenden Stellungnahmen der Vernehmlassungsteilnehmer sorgfältig auswerten lassen. Er will das Ergebnis der Vernehmlassung abwarten, das voraussichtlich noch Ende dieses Jahres vorliegen wird, bevor er sich zur Frage der Beibehaltung oder Aufhebung einzelner Steuerausnahmen äussert. Aus diesem Grund beantragt er zum heutigen Zeitpunkt, die Motion abzulehnen.
